Are we responsible for mold from an AC leak?« Back to Previous Page

Our AC unit in the master bedroom of our JVC apartment has been leaking a little, and now we’ve discovered a patch of black mold spreading on the wall behind the wardrobe. We reported the leak to the landlord a while ago, but they only sent someone to patch the drain line, not treat the mold. Are we responsible for the mold remediation and repair costs, or is it the building management's duty since it started with the AC leak?

The responsibility for mold remediation and repair costs in your JVC apartment depends on the source of the moisture. Since the mold growth was a direct result of a leaking AC unit, which is part of the property's provided fixtures, the financial responsibility typically falls on the landlord or building management.

Under typical Dubai rental regulations, landlords are obligated to maintain the property in a habitable condition, which includes addressing structural issues and repairing faults in provided appliances like AC units that lead to secondary damage. Your prior report about the leak is crucial evidence that the landlord was notified of the root cause. Their repair of the drain line alone was insufficient, as they also became responsible for rectifying the resultant damage, including the mold.

For a case like this with visible spreading, a professional inspection is strongly recommended to assess the full extent behind the wardrobe. Mold can penetrate drywall and insulation, requiring proper remediation, not just surface cleaning. In Dubai's high humidity, any lingering moisture will cause it to return quickly. Document everything with photos and your previous communication with the landlord. Politely reiterate your request for them to address both the cause and the mold damage, citing your initial report. If they remain uncooperative, you may need to escalate the matter through the Dubai Land Department's Rental Dispute Center.
