Is my landlord required to pay for mold remediation?« Back to Previous Page

My kids have been coughing and I suspect it's the black mold I just found behind the wardrobe in our master bedroom. We've lived in this Mirdif villa for two years and the problem seems to have gotten worse since the recent humidity. I've wiped it down with vinegar but it just comes back. Is the landlord legally required to pay for professional mold remediation, or is this on me as the tenant?

Under Dubai tenancy law, the landlord is responsible for maintaining the structural integrity of the property and addressing issues arising from inherent building defects, such as persistent water leaks or faulty waterproofing that lead to mold. The tenant is typically responsible for issues resulting from their own negligence or lifestyle, like inadequate ventilation.

Your situation in Mirdif points to a common humidity-driven problem. The recent high humidity, combined with potential condensation from year-round AC use, creates an ideal environment for mold behind large furniture where air doesn't circulate. Since you've cleaned it and it returns, the source is likely persistent moisture within the wall or a leak, which falls under the landlord's maintenance purview.

Document everything. Take clear photos and videos of the mold and any signs of moisture. Formally notify your landlord in writing (email is best) about the issue, mention your health concerns, and request they investigate and rectify the source of the moisture. For health-related cases with recurring mold, a professional inspection is advised to identify the exact moisture source and species of mold, as this provides concrete evidence for your request.

If the landlord refuses to act, you can file a complaint with the Rental Dispute Center (RDC) in Dubai. They will determine liability based on the cause. Your proactive cleaning attempts and documentation will support your case that this is a recurring structural issue, not a housekeeping one.
