Who is responsible for mold from a possible AC leak?« Back to Previous Page

We've lived in our Jumeirah villa for about 2 years, and just last week I finally pulled out the large wardrobe in the master bedroom to find a huge patch of black, fuzzy mold spreading up the wall behind it. The AC unit is on the other side of that wall and I'm worried there's a leak inside. My landlord is saying it's our fault for not ventilating the room properly, but we run the AC constantly. Who is legally responsible for getting this tested and cleaned in Dubai?

In Dubai, the landlord is generally responsible for structural issues and maintenance of fixed installations like AC units, which likely includes internal leaks. Your tenancy contract is the primary reference, but Dubai Law No. 26 of 2007 (as amended) typically places the duty of major maintenance on the property owner.

Your landlord's claim about ventilation is a common counterargument, but it may not hold. While daily activities like showering or drying clothes indoors contribute to humidity, a significant mold outbreak behind furniture on an AC wall strongly suggests an underlying leak or insulation issue from the unit itself—a structural problem. Running the AC constantly can sometimes exacerbate condensation problems if the unit is not draining properly or is too oversized for the space.

For any dispute, you must provide evidence. Do not clean it yet. First, document the mold with clear photos and videos. Then, insist on a professional inspection to identify the moisture source. A certified inspector can use moisture meters and thermal cameras to determine if the leak originates from the AC system, a pipe, or the building envelope. This professional report is crucial evidence for establishing liability.

If the landlord remains uncooperative, you can file a complaint with the Rental Dispute Settlement Centre in Dubai (RDSC). They will review the evidence, including the inspection report, to determine who is financially responsible for the testing and remediation.
