Who is responsible for mold from AC leak in apartment?« Back to Previous Page

The AC in our Jumeirah Village apartment has been leaking into the closet in the master bedroom for a couple of months. The landlord’s handyman came and “fixed” the leak but didn’t do anything about the dark black mold that’s now growing all over the back wall and our shoes. My wife has developed a really bad cough that won’t go away. Who is legally responsible here for the mold remediation – is it on me to clean it or is the property owner required to fix this and the health issue?

Under Dubai tenancy law, the property owner is typically responsible for repairing structural defects and maintaining the property, including fixing the source of an AC leak. The subsequent mold growth is a direct result of that unrepaired moisture issue, placing the remediation responsibility on the landlord.
The black mold you describe, especially given your wife's persistent cough, is a serious health concern. Stachybotrys, the "black mold" commonly found in chronic water damage, can produce mycotoxins and is strongly linked to respiratory irritation and allergic reactions. Dubai's high humidity and constant AC use create perfect conditions for this rapid growth. You should formally notify your landlord in writing (email is best) immediately. Reference the previous repair attempt that failed to address the mold. Clearly state the health impact. Request a professional mold remediation, not just a handyman's cleaning, as improper methods can aerosolize spores and worsen the problem. If the landlord is unresponsive, you can file a complaint with the Rental Dispute Center (RDC) in Dubai. Document everything with photos and a record of your communications. For health safety, a professional inspection with lab testing is critical to identify the mold species and the full extent of contamination, which is often hidden inside walls. This documented evidence is also essential for any legal dispute. Do not attempt to clean significant black mold growth yourself. |
