Is landlord responsible for mold from leak in Dubai?« Back to Previous Page

The wall behind our sofa in the living room has a large patch of black mold that’s been slowly growing since the heavy rains in Al Quoz a few weeks ago. We’ve tried wiping it down, but the dampness and smell keep coming back, and my husband’s allergies have been terrible. Is this something I need to fix myself, or is the landlord responsible for treating the mold and fixing the leak that’s causing it?

Under Dubai rental law (Law No. 26 of 2007), the landlord is responsible for maintaining the structural integrity of the property. This includes fixing leaks in the roof, external walls, or plumbing systems that are causing water intrusion and subsequent mold growth. Since the issue began after heavy rains and the dampness persists, this points to an ongoing structural moisture problem, not surface condensation.

You should formally notify your landlord in writing about the leak and the mold growth, as they are obligated to address the source. For health reasons, especially given your husband's allergic reactions, do not attempt to remove it yourself. Disturbing the mold can aerosolize spores and worsen indoor air quality. The damp smell returning confirms the colony is active and the root cause remains.

While the landlord handles the leak, the remediation of the resulting mold is often a point of negotiation. However, given the size and recurrence, a professional assessment is strongly advised to determine the extent of moisture damage within the wall cavity. In many cases, simply wiping the surface is insufficient if moisture has penetrated the building materials. A proper fix requires stopping the water source, thoroughly drying the structure, and then treating the affected area.

For verification, companies with their own microbiology labs can provide a detailed identification of the mold species and the moisture readings within the wall, which creates a clear report for your landlord on the necessary corrective actions.
