Is landlord responsible for mold removal as tenant?« Back to Previous Page

My kids have been coughing more than usual and I’ve just found a patch of black mold behind the wardrobe in our master bedroom in Jumeirah Village Circle. It’s been incredibly humid for the last month and the room doesn't get great airflow. As a tenant, am I responsible for the cost of professional mold removal, or is this something I need to report to the landlord to handle?

Under Dubai rental law, landlords are generally responsible for maintaining the structural integrity and habitability of a property. This includes addressing issues like mold that result from building defects, such as leaking pipes, faulty waterproofing, or inadequate ventilation systems. As a tenant, your responsibility is to report the issue promptly and maintain reasonable cleanliness and ventilation.

Given the high humidity and constant AC use in Dubai, mold often stems from condensation and poor airflow, especially in enclosed spaces like behind furniture. Your first step is to formally notify your landlord or property management company in writing, with photos of the mold and a description of the health symptoms. They are typically obligated to investigate and rectify the underlying cause.

For a patch behind a wardrobe, the remediation process may involve moving the furniture, cleaning the affected area with appropriate antimicrobial agents, and most importantly, identifying and fixing the moisture source. If the landlord disputes responsibility or the problem is extensive, you may need a professional inspection to determine the root cause. A certified inspector can provide a documented report that clarifies whether the issue is due to a maintenance defect (landlord's responsibility) or lifestyle factors (tenant's responsibility), which is crucial for any dispute.

Until it's resolved, improve airflow in the room by running the AC consistently, using a dehumidifier, and ensuring furniture isn't pressed tightly against walls.
