AC leak causing mold and headaches: landlord or tenant responsible?« Back to Previous Page

The AC in my apartment seems to be leaking a bit of water onto the wall in our main bedroom here in Jumeirah Village Circle, and now we’re seeing a spreading black patch behind the headboard. It’s been getting worse over the last month and my wife has started getting bad headaches. Who is responsible for getting this tested and cleaned, us as tenants or the building management?

Under Dubai law (RERA tenancy contract), the landlord is responsible for maintaining the structure of the property, including the fixed AC unit and any resulting water damage to walls. You are responsible for reporting the issue promptly.

The black patch is likely Stachybotrys, a toxigenic mold common in Dubai due to high humidity and AC condensation leaks. It can cause persistent headaches and sinus issues. Immediately move the bed away from the wall to reduce exposure. Do not attempt to clean it yourself, as improper methods aerosolize spores and worsen the problem.

Formally notify your building management and landlord in writing (email is best), including photos of the leak and mold. Request immediate repairs to the AC drain line and a professional mold inspection. For health symptoms and legal clarity, a certified inspection with lab analysis is essential to document the species and concentration. This report is often needed to compel landlord action and plan safe remediation.

If they are unresponsive, you can file a complaint with the Dubai Land Department's Rental Dispute Center. The process is tenant-friendly, but having a professional lab report provides concrete evidence for your case.
