Is landlord resposible for mold removal in JVC?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold that's been spreading along the bedroom wall behind the wardrobe. We've lived here for 2 years and just noticed it when we moved the furniture last week. The dehumidifier isn't making a dent in the dampness. Am I responsible for the mold removal costs, or is this something my landlord in Jumeirah Village Circle has to handle?

Under Dubai rental law, the landlord is typically responsible for addressing the root cause of the mold, which is the moisture intrusion. This includes repairing structural leaks, faulty plumbing, or inadequate waterproofing that led to the damp wall behind your wardrobe. The tenant is generally responsible for mold resulting from their own actions, like inadequate ventilation or failing to use the AC.

Given the description of a hidden, spreading black mold colony and persistent dampness that a dehumidifier cannot control, this strongly suggests a structural moisture issue. The year-round AC use in our climate is essential for controlling humidity, but it cannot compensate for a continuous water source like a leak.

Your first step is to formally notify your landlord in writing about the suspected leak and mold growth, including the photos you took when you moved the wardrobe. Request immediate repairs to the moisture source. For a case involving potential black mold and health symptoms, a professional inspection is highly recommended to identify the exact moisture source and mold species. This provides documented evidence of the cause, which is crucial if the landlord disputes responsibility.

If the landlord refuses to address the repairs, you can file a complaint with the Rental Dispute Center (RDC) in Dubai. They will assess whether the issue constitutes a breach of the landlord's obligation to provide a habitable property. In the meantime, ensure you are ventilating the area well and keep the AC running to help manage ambient humidity levels.
