Is landlord responsible for mold removal from hidden leak?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for two years and just noticed a large patch of black mold behind our wardrobe in the master bedroom. It must have been growing slowly from a hidden water leak. My husband has started getting bad allergies and we're worried it's the cause. Are we responsible for the mold removal and repair costs, or is this something our landlord has to handle?

Under Dubai rental law (Law No. 26 of 2007), the landlord is typically responsible for remedying structural issues and defects in the property, including hidden water leaks that cause mold. Since this is a concealed leak behind a wardrobe, it is highly likely the landlord is responsible for both the leak repair and the subsequent mold removal.

Your first step is to formally notify your landlord or property management company in writing, with clear photos of the mold and a description of the health symptoms. They are obligated to address the source of the problem—the leak—to prevent recurrence. For a case this significant, a professional inspection is essential to confirm the leak's origin and the full extent of the mold growth, which is often more widespread than what is visible.

The UAE's high humidity and constant AC use can cause condensation issues that exacerbate mold problems, making proper remediation critical. Do not attempt to remove it yourself with bleach, as this can aerosolize spores and worsen allergies. Inhabiting a space with active mold, especially with health symptoms present, is not advised.

If the landlord refuses to act, you can file a complaint with the Dubai Land Department's Rental Dispute Center (RDC). Having a documented report from an independent mold inspection company will significantly strengthen your case, as it provides evidence that the issue is structural and not due to tenant negligence like poor ventilation.
