Is mold removal my responsibility as a tenant?« Back to Previous Page

The wall behind our sofa in the living room has these dark, fuzzy patches that have gotten way worse since the weather got humid. We’ve been in this Marina apartment for about a year and never had an issue until now. I’m worried it’s making my allergies act up every evening. As a tenant, am I responsible for paying to get this professionally removed, or is that the building management's job since it might be a leak?

In Dubai, responsibility depends on the source of the moisture causing the mold. As a tenant, you are responsible for mold caused by your own activities, like inadequate ventilation leading to condensation. However, if the mold is a result of a building defect—such as a leaking pipe inside the wall, faulty external waterproofing, or a leaking AC condensation drain line—then the responsibility falls to the landlord or building management.

Given your description of the wall behind the sofa and the recent humidity, this is a common scenario in Marina apartments. The wall could be an exterior wall with inadequate insulation, creating a cold spot where condensation forms when the AC is running. Alternatively, a leak from an upstairs unit or within the building envelope is possible.

Your first step is to formally notify your landlord and building management in writing, with photos. They are typically obligated to investigate and repair the source of the water intrusion under Dubai rental law, as it affects the habitability of the property. Do not attempt to remove the mold yourself, as disturbing it can release a large number of spores and worsen your allergy symptoms.

A professional inspection is crucial to identify the exact moisture source. They will use moisture meters and thermal imaging to determine if the issue is condensation or an active leak. The actual mold removal should only begin after the water source is permanently fixed; otherwise, it will return. For a case this visible, professional remediation is strongly advised to ensure it is handled safely and thoroughly.
