Is landlord responsible for black mold above AC vent?« Back to Previous Page

We've lived in our Jumeirah Village Triangle apartment for 2 years and just noticed a patch of black, fuzzy mold spreading from the corner of our bedroom ceiling, right above the AC vent. It’s gotten way worse since the humidity spiked last month. I’m worried about my family’s health, but is this something I need to fix myself or is my landlord legally responsible for the remediation?

Black mold above an AC vent is a common issue in Dubai due to the high humidity and constant AC use, which creates condensation. Under Dubai tenancy law, specifically Law No. 26 of 2007, the landlord is generally responsible for the maintenance of the building's structure, including the central AC system and any issues arising from it that affect the property's habitability. Since the mold is spreading from a ceiling corner connected to the AC vent, this strongly suggests a systemic issue like a clogged condensate drain line or insufficient insulation causing condensation—both structural maintenance items.

Your first step is to formally notify your landlord or property management company in writing, including clear photos of the mold's location and progression. They are obligated to address problems that make the property unfit for living. Do not attempt to clean significant black mold yourself, as improper disturbance can aerosolize spores and worsen indoor air quality.

Given the visible spread and its location at the vent, a professional inspection is highly recommended to diagnose the root cause. The inspection will determine if the issue is a simple clog, an AC unit malfunction, or a building envelope deficiency. For health verification, a lab test can identify the mold species, but visible growth of this nature warrants remediation regardless. The landlord should arrange for a qualified remediation team that follows industry standards to fix the leak source, safely remove the contaminated materials, and restore the area. Keep records of all communications, as this is crucial if a dispute arises with the landlord.
