Is landlord responsible for black mold near AC unit?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for two years and just noticed a patch of black mold spreading from the corner of the bedroom ceiling, right where the wall meets the AC unit. It's gotten much worse since the humidity spiked last month. Is this something I need to fix myself, or is my landlord legally responsible for handling and paying for the remediation?

Under Dubai's tenancy law, landlords are generally responsible for maintaining the structural integrity and habitability of the property, which includes addressing issues like mold caused by building defects or faulty installations. Since the mold originates from the AC unit—a landlord-provided fixture—and is likely due to condensation or a drainage issue, this is typically their responsibility to rectify.

The high humidity here causes significant condensation within AC systems, and a clogged drain line or poor insulation around the unit is a common source of moisture leading to ceiling mold. You should formally notify your landlord or building management in writing immediately, including clear photos. They are obligated to investigate and fix the source of the moisture, not just paint over the mold.

For a case that is actively spreading, a professional inspection is advised to identify the exact moisture source and extent. Remediation involves fixing the leak or condensation issue, properly removing the contaminated materials, and treating the area to prevent recurrence. Simply cleaning the visible patch will not solve the underlying problem. If the landlord is unresponsive, you can file a complaint with the Dubai Land Department's Rental Dispute Center. Document all communications and the condition thoroughly.
