Who is responsible for mold remediation costs?« Back to Previous Page

My kids have been coughing non-stop for the past month and I finally pulled their bed away from the wall in our Deira apartment to find a huge patch of black mold hidden behind it. The landlord says it's from our AC being too cold, but we keep it at 24. Who is actually responsible for the inspection and remediation costs here, us or the landlord?

Under Dubai rental law, the landlord is typically responsible for remedying structural issues that lead to mold, such as leaks in external walls, roofs, or plumbing. The tenant is responsible for issues caused by their own negligence, like failing to report a leak or improper ventilation.

The landlord's claim that your AC setting caused the mold is scientifically incorrect. Mold requires moisture, not cold. In Dubai's climate, the primary cause is condensation from high humidity meeting cold surfaces, or water intrusion from leaks. An AC set to 24°C is not the root cause; the issue is likely inadequate insulation within the wall (a building envelope flaw) or a hidden pipe leak, both of which are the landlord's responsibility to investigate and fix.

Your first step is to formally notify the landlord in writing (email is best), include photos of the mold, and request immediate remediation. For a patch large enough to cause persistent respiratory symptoms, a professional inspection is strongly advised to identify the exact moisture source. Remediation involves fixing the water source, not just cleaning the visible mold. If the landlord refuses to act, you can file a complaint with the Rental Dispute Center (RDC) in Dubai. Document all communication, as this will be crucial evidence.

Until resolved, improve airflow in the room. Keep furniture slightly away from walls and ensure your AC unit is draining properly, as a clogged drain line can contribute to indoor humidity. For the health of your children, addressing the underlying cause is the only permanent solution.
