Who is responsible for fixing black mold from damp wall?« Back to Previous Page

The wall behind my wardrobe in our bedroom has been damp for a couple of months, and now there's a huge patch of black mold spreading. We're in an older building in Bur Dubai and the AC unit is in the wall right there, which might be the cause. Who is responsible for fixing this and the cost – is it me as the tenant or is my landlord supposed to handle the remediation?

In Dubai, the responsibility for fixing this typically falls on the landlord, as they are obligated to maintain the property's structure and ensure it is habitable. This includes addressing issues like water leaks and the resultant mold, which are considered structural defects. Your first step should be to formally notify your landlord or property management company in writing, including photos of the damp wall and mold.

The proximity to the AC unit is a critical clue. In Bur Dubai's older buildings, AC drain lines often clog or condensate pans crack, leaking water directly into the wall cavity. This constant moisture, combined with our high humidity, creates an ideal environment for rapid mold growth behind furniture like wardrobes.

Do not attempt to clean this yourself, as a large patch indicates a significant moisture problem within the wall. Disturbing it can release spores and worsen the indoor air quality. A professional inspection is necessary to identify the exact moisture source—whether it's the AC unit, a pipe leak, or external seepage—and assess the full extent of the mold growth.

The remediation process should involve fixing the water source, then properly removing the contaminated materials and treating the area. For a case this advanced, only a lab-based post-remediation verification test can confirm the space is safe. Your landlord should arrange and cover the cost for this repair. If they are unresponsive, you can escalate the matter to the Dubai Land Department (DLD) or the Rental Dispute Center, as a mold issue of this severity constitutes a breach of their maintenance obligations.
