Who is responsible for mold repair in a rental?« Back to Previous Page

The wall behind my wardrobe in our bedroom has been getting these black spots for a couple of months, and it’s spreading since the weather got more humid. We’re renting an apartment in Jumeirah Village Circle, and I’m worried it’s affecting our health. Who is responsible for fixing this and paying for the repairs, me as the tenant or my landlord?

In Dubai rentals, the landlord is generally responsible for structural repairs, including mold remediation caused by building issues like leaks or poor insulation. The tenant is responsible for damage resulting from their own negligence, like failing to use the AC properly to control humidity.
Since your mold is behind a wardrobe and worsened with humidity, it's likely due to condensation—a common issue in JVC apartments where exterior walls can cool and attract moisture from the humid air. Document the issue thoroughly with dated photos and notify your landlord in writing immediately. Under Dubai's rental laws, they are typically obligated to address problems that affect the property's habitability and your health. For a case that is spreading, a professional inspection is wise to identify the moisture source. Remediation often involves moving the furniture, cleaning the mold with appropriate biocides, and most importantly, fixing the underlying cause, such as improving wall insulation or ventilation. Without addressing the source, it will likely return. Before undertaking any repairs yourself, communicate with your landlord and obtain their agreement, as unauthorized work could complicate your security deposit return. If the landlord is unresponsive, you can file a complaint with the Dubai Rental Dispute Center (RDC). |
