Who is responsible for black mold removal cost, landlord or me?« Back to Previous Page

My kids have been coughing and I suspect it’s from the black mold that’s been spreading along the corner of our master bedroom wall in our Jumeirah Village Triangle apartment. It started as a small patch after the heavy rains in January but has gotten way worse, especially with the humidity. Who is responsible for fixing this and the cost, me or my landlord?

The responsibility for mold removal costs in Dubai rentals depends on the source of the moisture. Under the Dubai Rental Law, landlords are responsible for maintaining the structural integrity of the property. If the mold is a result of a building envelope issue—like a leaking roof, faulty external waterproofing, or a burst pipe within the walls—the repair and remediation cost falls on the landlord.

However, if the moisture source is tenant-caused, such as inadequate ventilation leading to condensation, blocking AC units, or internal water damage not reported promptly, the tenant would typically be responsible for the cleanup.

Your situation in Jumeirah Village Triangle is a common one after winter rains; water can seep through the smallest cracks and then mold flourishes with our high humidity. The initial cause is key. A professional inspection can identify the moisture source definitively, which is essential for determining liability. They can differentiate between a construction defect and condensation from daily living.

Document the mold's growth with dated photos and immediately notify your landlord in writing, detailing the issue and your health concerns. Request a professional assessment. For a case this severe, with health symptoms involved, a lab test to identify the mold species is also advisable to understand the potential risk. Do not attempt to remove extensive black mold yourself, as improper handling can aerosolize spores and worsen the problem.
