How to get building management to fix ceiling leak in Dubai?« Back to Previous Page

We've lived here for 2 years and just noticed a small, damp patch on the ceiling of our spare bedroom in Jumeirah. It’s slowly gotten bigger since last week’s heavy dew, and now there's a bit of flaking paint. What are the Dubai Municipality procedures for getting this inspected by the building management, and are they obligated to fix it?

Based on Dubai Municipality's strata laws and building regulations, your situation is a common one, especially following heavy dew or rain. The responsibility for repairs falls squarely on the building management or the Owners' Association, as per Jointly Owned Property Law No. (6) of 2019. The common property, which includes the main structure, roofing, and central AC condensation lines, is their legal obligation to maintain.

Your first actionable step is to formally notify your building management company in writing. Be specific: detail the location (spare bedroom), the onset (post-heavy dew), and the progression (damp patch expanding, paint flaking). This creates a dated record. They are obligated to engage a certified contractor to investigate the source, which is likely a leaking roof membrane, a failed seal around AC ducting, or a leaking pipe from the apartment above.

If the response is delayed or inadequate, you can escalate to Dubai Municipality's Building Inspection Department. They have the authority to issue a violation notice to the management, compelling action. However, before escalation, I strongly recommend a professional indoor environmental inspection. We often find that what's visible is a small part of a larger moisture issue, potentially leading to mold growth within the ceiling void, which poses health risks. A certified report from a company like ours can pinpoint the exact cause and required remediation, strengthening your case with the management.
