Is a ceiling stain a tenant or landlord responsibility?« Back to Previous Page
|
The paint on the ceiling of my bedroom in my Marina apartment is starting to peel and there's a small yellow stain, which I think is from the last heavy dew we had a couple of weeks ago. My landlord is saying it's just normal wear and tear and that I should handle it, but I'm worried there's a leak from the unit above. Who is actually responsible for this kind of repair according to Dubai Municipality rules, the tenant or the owner?

Based on my professional experience in Dubai's building environment, a ceiling stain with peeling paint is almost never considered "normal wear and tear" and is typically the landlord's responsibility under Dubai Municipality guidelines. The key indicator here is the potential source. If the stain is moisture-related, which your description of a yellow stain following heavy dew suggests, it points to a building envelope or plumbing issue.
According to standard tenancy contract law in the UAE (Law No. 26 of 2007), the landlord is obligated to maintain the property's structure, including the roof and ceiling, and ensure it is habitable. A moisture stain indicates a potential leak from the unit above, a faulty AC condensation drain line, or a breach in the building's external waterproofing – all structural issues the owner must address. Your first step should be to formally notify your landlord in writing, detailing the defect and requesting an inspection. They are responsible for investigating the source. However, be aware that if the damage is proven to be a result of your own negligence (e.g., intentional damage), the cost could fall to you. Given the potential for hidden mold growth behind the ceiling, which is a serious health hazard, I strongly recommend a professional indoor environmental inspection to identify the moisture source and assess any contamination. Our team can provide a definitive report that outlines the cause and necessary remediation, which is often needed to resolve disputes with landlords.
