Is bathroom mold repair a tenant or landlord responsibility?« Back to Previous Page

The grout between the tiles in our master bathroom shower has been turning black over the last few months, and now there's a persistent damp smell in the whole room. We're in an older building in Deira and I'm worried it's spreading behind the walls. As a tenant, am I responsible for paying to get this professionally treated, or is this the building management's job to fix?

In the UAE, the responsibility for mold remediation in a rental property is primarily dictated by the tenancy contract and Dubai Law No. 26 of 2007 (Amended by Law No. 33 of 2008), known as the Dubai Rental Law. Generally, the landlord is responsible for maintaining the structural integrity of the property, which includes the building's main walls, plumbing systems embedded within the structure, and waterproofing. The black discoloration in your shower grout and the associated damp smell strongly indicate a persistent moisture issue, likely stemming from failed shower pan waterproofing or leaking pipes behind the tiles—both of which are structural defects and fall under the landlord's obligation to repair.

However, tenants are responsible for damage resulting from negligence, such as a failure to use the ventilation system properly. Given Dubai's high humidity levels and the constant use of AC, which can create significant condensation if not managed, proper ventilation is critical. You must demonstrate that you have used the extractor fan and kept the area well-ventilated.

Given your description of an older building in Deira and the suspicion of spread behind the walls, this is a serious case requiring immediate professional attention. A DIY approach is insufficient and risks extensive structural damage and health impacts. I strongly recommend you formally notify your landlord or building management in writing, with a request for a professional mold inspection. This inspection will use moisture meters and borescopes to determine the source and extent of the hidden contamination, which is crucial for assigning responsibility.
