Is black mold in my apartment the landlord's responsibility?« Back to Previous Page

We've lived here for 2 years and just noticed a bunch of black spots spreading along the wall behind the wardrobe in our bedroom in Jumeirah Village Circle. It’s been super humid lately, and the AC in that room seems to struggle to keep up. Who is responsible for dealing with this and the cost – me as the tenant or my landlord?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for the maintenance of the property's main structure, including issues arising from inherent building defects or problems with essential services like the central AC system. The black mold spreading behind your wardrobe in JVC is a serious health and safety issue, and its cause is critical in determining responsibility.

If the mold is a direct result of a structural issue, such as a hidden water leak from plumbing or a faulty AC drainage line within the walls, the financial responsibility for the inspection, testing, and remediation falls squarely on the landlord. Similarly, if the building's overall ventilation is inadequate, that is their duty to address.

However, as a tenant, you are responsible for maintaining the property through adequate ventilation and reporting issues promptly. The recent high humidity is a factor, but if the mold growth was exacerbated by a lack of air circulation (e.g., furniture pressed directly against the wall) or failing to use the AC sufficiently to control humidity, you could be liable for the cost of the cleanup.

Given the spread you've described, a professional inspection is absolutely essential. We need to identify the moisture source and the mold species to determine the cause and scope of remediation required. DIY attempts can worsen spore spread. We can provide a detailed report that outlines the cause, which is crucial for discussions with your landlord.
