Is black mold the tenant's or landlord's responsibility?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for two years and just noticed black mold spreading along the base of the wall behind our bedroom wardrobe. It seems to have gotten much worse since the humidity spiked last month. The landlord is saying it's our fault for not ventilating the room properly, but we always run the AC. Are we legally responsible for the cleanup and repair costs, or is this the building owner's duty?

Based on the UAE Civil Code (Federal Law No. 5 of 1985), the responsibility for structural repairs and issues arising from the property's inherent condition typically falls on the landlord. This includes problems like persistent water leaks from external walls, faulty AC drainage systems within the building's ducting, or inadequate insulation that leads to condensation – all common causes of the black mold you're describing behind the wardrobe.

Since you've been running the AC consistently, which is the primary method of humidity control here, the argument that improper ventilation caused this is weak. The location behind a large piece of furniture is a classic spot for condensation to form due to poor air circulation and a potential "cold bridge" in the wall, which is a construction issue, not a tenant one.

Your first step is to formally notify your landlord in writing (email is best) with clear photos, requesting they address the issue. Do not attempt to clean it yourself, as improper disturbance can spread spores. For a definitive assessment of the cause and to document the extent of the infestation for your landlord, a professional mold inspection is crucial. We can perform tests to identify the moisture source and provide a legally valid report.

If the landlord remains uncooperative, this report becomes essential evidence for filing a complaint with the Dubai Land Department (DLD) or the Rental Dispute Center. For an inspection and detailed report to protect your interests, call us at 800-MOLDS or email hello@saniservice.com.
