Is landlord or tenant responsible for mold repair?« Back to Previous Page
|
The paint on the ceiling of our kids' bedroom in our Jumeirah Village Circle apartment has started to peel and bubble, and we noticed a small patch of mold in the corner after the humidity last week. Our landlord is insisting we need to get a "certified" contractor to fix the moisture issue and repaint, but isn't being clear about who is supposed to arrange and pay for it.
Is it my responsibility as the tenant to find and hire this certified professional, or should the property management company be handling it directly?

Excellent and very common question. This situation in JVC is a textbook case of a landlord's responsibility under UAE tenancy law.
The peeling paint and mold are clear indicators of a persistent moisture intrusion, likely from a leak in the building envelope or a faulty AC condensation drain line—common issues in our climate. This is a structural or maintenance defect, not damage caused by tenant behavior. Under Dubai Law No. 26 of 2007 (Amended by Law No. 33 of 2008), the landlord is unequivocally responsible for maintaining the property's main structure, including walls and ceilings, and ensuring it is habitable. Moisture intrusion and resultant mold fall squarely under this obligation. The landlord's insistence on a "certified" contractor is actually correct and works in your favor; it acknowledges the need for a professional remediation process, not just a cosmetic paint job. However, it is the landlord's (or their property management company's) duty to engage and pay for this certified service. Your responsibility as the tenant is to report the issue promptly, which you have done. Do not hire a contractor yourself. You risk voiding any agreement and being held liable for improper repairs. Instead, formally notify the landlord/property manager in writing (email is best), reiterating the issue and requesting immediate action by their certified contractor. Mention the potential health risks, especially in a child's bedroom. For a case like this, I strongly recommend a professional inspection to identify the exact moisture source before any repairs begin. We provide detailed moisture mapping and IAQ (Indoor Air Quality) reports that are legally recognized and can definitively pinpoint the cause, forcing the landlord's hand. If they remain unresponsive, you can file a complaint with the Rental Dispute Center in Dubai. For immediate expert assessment, you can call our team at 800-MOLDS or email hello@saniservice.com. |
