Is landlord responsible for AC leak and mold remediation?« Back to Previous Page

The AC in my bedroom unit has been leaking a bit, and now I’m finding black spots spreading on the wall behind the wardrobe. It’s been slowly getting worse over the last month. My tenancy contract is a bit vague about this – is fixing this the landlord's responsibility or am I expected to handle and pay for the mold remediation myself?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for the maintenance of the property's main structure and key utilities, which includes the central air conditioning system and the building envelope. An AC leak falls squarely under this category as it is a structural or mechanical defect in the property's provided appliance.
The resulting mold growth is a direct consequence of that unresolved water intrusion. Therefore, the remediation of the mold caused by the AC leak is also the landlord's obligation. Your tenancy contract being vague doesn't override this statutory responsibility. You should formally notify your landlord or property management company in writing immediately, detailing the issue and requesting urgent repairs and professional mold remediation. Include clear photographs of the leak and the spreading black spots. However, it is critical to have the situation professionally assessed. what appears as superficial spotting can often indicate more significant hidden growth within the wall cavity, especially behind fixed furniture. DIY attempts can disturb spores and exacerbate the problem. We strongly recommend a certified mold inspection to determine the full extent of the contamination and to provide a formal report, which can be used to ensure the landlord conducts proper remediation, not just a superficial cleaning.
