Is landlord responsible for black mold in rental?« Back to Previous Page

My kids have been coughing more than usual and I suspect it’s from the black mold that’s spreading on the ceiling in our master bedroom closet. It’s been getting worse since the humidity spiked a couple of months ago, but my landlord says it's our fault for not ventilating properly. Who is actually responsible for the mold remediation and repair costs in a rental here?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the landlord is fundamentally responsible for maintaining the property's structural integrity and ensuring it is habitable. This includes addressing issues arising from inherent building defects, such as faulty waterproofing, leaking central AC systems, or inadequate insulation that leads to condensation. The chronic humidity in Dubai is a well-known environmental factor that landlords must account for. If the black mold in your closet is a result of a roof leak, a leaking pipe within the walls, or condensation from an improperly insulated AC duct, the remediation and repair costs fall squarely on the landlord.

However, the landlord's argument about ventilation does hold some weight. Tenant responsibilities, as outlined in standard rental contracts (Ejari), include maintaining adequate ventilation to prevent moisture buildup, especially in high-humidity areas like bathrooms and closets. If the mold is solely due to a tenant's failure to use exhaust fans or periodically run the AC to dehumidify the space, you could be held liable.

Given that the mold is spreading and your children are exhibiting health symptoms, this is a serious case. The landlord's claim must be professionally verified. We strongly recommend a certified mold inspection to determine the exact moisture source and species of mold. Our experts at Saniservice use thermal imaging cameras and hygrometers to identify hidden leaks and measure humidity levels, providing a definitive report on the cause. This evidence is crucial for resolving liability disputes. Do not attempt to remove significant black mold yourself, as improper remediation can aerosolize spores and worsen the problem.
