Is landlord responsible for black mold in rental apartment?« Back to Previous Page

My kids have been coughing and I suspect it’s from the black mold that’s been spreading along the grout in our master bathroom shower. It started as a small spot a couple of months back, but after the recent humidity, it's gotten way worse and the damp smell is constant. We've been renting this apartment in Jumeirah Lakes Towers for three years without any issues before this.
Is the landlord responsible for fixing this, or is cleaning the mold considered my job as a tenant?

In the UAE, the responsibility for mold remediation in a rental property is typically defined by the tenancy contract and Law No. (26) of 2007, known as the Dubai Rental Law. Generally, the landlord is responsible for addressing structural issues and faults within the property that lead to problems like persistent mold growth. This includes resolving underlying causes such as faulty bathroom ventilation, leaking pipes within the walls, or inadequate waterproofing that allows moisture to penetrate the grout and substrate.
However, as a tenant, you are responsible for general upkeep and maintenance, which includes routine cleaning to prevent mold caused by daily activities like showering. The key differentiator is the root cause. Given your description of a small spot rapidly expanding after a period of high humidity and a constant damp smell, this strongly suggests a systemic issue beyond surface condensation. The persistent humidity in Dubai, combined with year-round AC use that can create temperature differentials and condensation, often exacerbates hidden leaks or insufficient exhaust fan operation. The health symptoms you describe, particularly in children, underscore the need for professional intervention. Surface cleaning with bleach is a temporary fix that does not address the hidden moisture source or the mycotoxins present. We strongly recommend you contact your landlord immediately, informing them of the suspected structural moisture issue and the associated health concerns. For a definitive assessment and to protect your family's health, a professional inspection is crucial. Our certified experts at Saniservice can conduct a comprehensive assessment to identify the exact moisture source, perform air quality testing to quantify spore levels, and provide a detailed remediation protocol. This professional report will also be vital evidence for your landlord. Please call us at 800-MOLDS (800-66537) or email hello@saniservice.com to schedule an inspection. |
