Is landlord responsible for closet mold in my apartment?« Back to Previous Page

Our master bedroom closet in our Marina apartment has had a lingering damp smell for the last couple of months, and I just found a patch of black mold growing on the back wall behind our clothes. We run the AC constantly, but it feels really humid in that corner. As a tenant, am I responsible for cleaning this myself, or is the landlord supposed to handle mold remediation like this?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the landlord is generally responsible for maintaining the structural integrity of the property and addressing issues that affect its habitability. This includes problems like mold resulting from inherent building defects, such as leaking pipes within the walls, faulty external waterproofing, or defective AC drainage systems that cause condensation.

However, as a tenant, you have a responsibility to use the property in a reasonable manner and to promptly notify the landlord of any issues. If the mold is determined to be a result of tenant behavior—like severely obstructing ventilation, failing to use the AC properly, or not reporting a minor leak immediately—the liability could shift.

In your Marina apartment, the constant AC use is good, but the localized humidity suggests a specific issue in that closet. It could be a lack of air circulation, a cold bridge in the wall, or a hidden leak. The fact that it's on an external wall is a major red flag for a potential construction-related moisture intrusion.

My strong recommendation is to NOT attempt remediation yourself. Disturbing mold without proper containment can spread spores throughout your apartment. You need a professional inspection to identify the exact moisture source. This is critical, as any remediation will fail if the root cause isn't fixed first.

Report this in writing to your landlord or property management company immediately, and insist on a certified mold inspection. We can provide a detailed report for them outlining the cause and scope of work, which is often needed to get them to act.
