Is landlord responsible for mold and water damage?« Back to Previous Page

We’ve been living in a JBR apartment for about a year, and ever since the flooding a few weeks ago, the corner of our master bedroom wall has had a huge, dark damp patch that’s starting to flake. The carpet in that area is still slightly squishy and it smells really moldy. Is it my landlord's responsibility to fix the water damage and replace the carpet, or is this on me to handle?

Based on the UAE Civil Code, specifically Federal Law No. 5 of 1985, the landlord is fundamentally responsible for maintaining the property's structural integrity and ensuring it is habitable. This includes addressing major issues like water damage from flooding, which is considered a structural defect.

In your case at JBR, the damage stems from a major external event (the flood), not from your negligence (like leaving a window open during AC operation or an internal spill you didn't report). The persistent damp patch, flaking wall, and saturated carpet are clear indicators that the building envelope was compromised. The mold growth is a direct consequence of this unresolved moisture intrusion. The landlord is obligated to repair the leak source, likely from the building's exterior or a buried pipe in the slab, remediate the mold, and replace the damaged building materials like the carpet and drywall.

However, you must have reported the issue promptly after the flood occurred. Delay in reporting can sometimes complicate liability.

Given the severity you describe – a "huge" patch, "squishy" carpet, and a pronounced moldy smell – this is a serious case requiring professional intervention. DIY cleaning is insufficient and hazardous. The moisture is likely trapped within the wall cavity and subfloor, requiring specialized equipment for drying and antimicrobial treatment to ensure the mold is eradicated and not just surface-cleaned.

I strongly recommend you formally request in writing that your landlord arranges for a professional inspection and remediation immediately. For a certified assessment and to handle this correctly, you or your landlord can call our specialists at 800-MOLDS (800-66537) or email hello@saniservice.com. This is absolutely the landlord's responsibility to fix.
