Is landlord responsible for mold inspection in rental?« Back to Previous Page

My kids have been coughing and I suspect it might be from mold in our bedroom closet. We've lived here for 2 years in a Marina high-rise and just noticed a patch of black spots on the back wall after pulling out some old suitcases. Who is responsible for getting a professional mold inspection done, me as the tenant or the landlord, and how do I approach them about it?

In the UAE, specifically Dubai, the responsibility for mold inspection and remediation in a rental property is typically outlined in the tenancy contract and governed by the Dubai Rental Law (Law No. 26 of 2007). Generally, the landlord is responsible for maintaining the structural integrity of the property and addressing issues arising from inherent building defects, such as faulty waterproofing, leaking central AC ducts, or seepage from external walls. Mold resulting from these types of structural or maintenance failures is the landlord's financial and legal responsibility to rectify.

However, if the mold growth is determined to be a direct result of tenant negligence—for instance, lack of ventilation, failing to use AC leading to humidity buildup, or water damage from an internal source not reported—the cost could fall to you, the tenant. Given your situation with the closet and the health symptoms, a professional inspection is critical to determine the root cause.

My strong recommendation is to formally notify your landlord or property management company in writing immediately. Clearly describe the issue, mention the potential health impact on your children, and insist on a professional mold inspection to assess the source and extent. Do not attempt to clean it yourself, as improper handling can aerosolize spores and worsen the problem. The inspection report will be the key document that determines liability.

For a definitive assessment, our certified technicians can conduct a comprehensive inspection, including moisture mapping and air quality testing, to identify the moisture source and provide a legally valid report. Call 800-MOLDS or 800-66537 to schedule an urgent inspection.
