Is mold on my apartment wall the landlord's responsibility?« Back to Previous Page

The wall behind our sofa in the living room of our Jumeirah Village Circle apartment has these black speckles that have been slowly spreading for a couple of months. We run the AC constantly, but the room always feels a bit damp. Since my landlord is responsible for the building's structure, am I supposed to report this for them to fix, or is dealing with the mold itself my responsibility as the tenant?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the responsibility for structural repairs and maintenance of the property, including issues arising from the building's fabric, falls upon the landlord. The black speckles spreading behind your sofa in Jumeirah Village Circle are a classic sign of a mold colony, and the persistent damp feeling despite AC use strongly suggests an underlying structural issue, such as a hidden water leak from a pipe or a breach in the building envelope.

Your first step is to formally notify your landlord or property management company in writing immediately. Provide clear photographs and detail the issue. They are obligated to address the root cause of the moisture intrusion. However, it is often the tenant's responsibility to maintain the interior cleanliness, which can include surface mold resulting from daily living (like condensation from cooking). In this case, given the description of its spread and the constant dampness, this is highly likely a landlord issue.

Crucially, do not attempt to clean this yourself. Disturbing the mold can aerosolize spores, potentially causing health issues and spreading the contamination. The root cause MUST be identified and fixed first, or it will simply return.

We strongly recommend a professional inspection to determine the exact moisture source and the extent of the mold growth, which may be more widespread than visible. This provides documented, expert evidence for your landlord.
