Is my landlord responsible for black mold remediation?« Back to Previous Page

We've lived here for 2 years and just noticed a patch of black mold in the corner of our master bedroom closet, which is on an exterior wall. It seems to have gotten worse since the humidity spiked last month. I’m worried about my family’s health, but I’m not sure if this is something I need to fix myself or if my landlord in Jumeirah is responsible for the mold remediation costs.

In the UAE, specifically under Dubai's Rental Law (Law No. 26 of 2007), the responsibility for maintenance falls on the property owner. This includes addressing issues that affect the habitability and structural integrity of the unit, such as water leaks or moisture ingress from building defects that lead to mold growth. Since your mold is on an exterior wall and correlated with a humidity spike, the root cause is likely a hidden leak or inadequate insulation/waterproofing, which is a structural issue and thus the landlord's responsibility.

Your first step is to formally notify your landlord or property management company in writing about the issue, including clear photographs. They are obligated to investigate and address the source of the moisture. However, the responsibility for remediating the mold itself can become complicated. If the mold growth is due to tenant negligence, such as a failure to use provided AC systems adequately or poor ventilation leading to condensation, the cost may fall on you.

Given the potential health risks of black mold (especially for respiratory issues), we strongly advise against DIY removal. Disturbing it can aerosolize toxic spores. A professional inspection is critical to identify the exact species and the full extent of contamination, often hidden within walls. This detailed report will be essential evidence for your landlord and will definitively outline the required scope of remediation.
