Is my landlord responsible for mold removal?« Back to Previous Page

My kids have been coughing and I suspect the black spots behind the wardrobe in our bedroom are to blame; it's been humid for months in our Jumeirah apartment. We've lived here for 2 years and just noticed this when we moved the furniture to clean. As a tenant, am I responsible for the DIY removal and cost, or is this something the landlord has to handle since it might be a building ventilation issue?

Based on the UAE Civil Code and Dubai rental law (Law No. 26 of 2007), the responsibility for mold remediation hinges on the root cause.

As a tenant, you are responsible for maintaining the property's cleanliness and reporting issues promptly. However, the landlord is legally obligated to provide a habitable property and is responsible for rectifying any structural or maintenance-related defects that affect this. The persistent humidity you describe, especially in a Jumeirah apartment, is a major red flag. This is often caused by underlying issues like faulty air conditioning systems, inadequate ventilation, or water seepage from external walls or leaking pipes—all of which are the landlord's responsibility to investigate and fix.

Attempting a DIY removal is highly discouraged. The black spots behind the wardrobe are likely just the visible tip of the iceberg; the mold can penetrate deep into building materials. Improper cleaning with bleach or other store-bought solutions can agitate the spores, spreading them further and increasing your family's exposure, which could be the cause of your children's coughing. Only a professional inspection can determine the true extent and the exact moisture source.

Your first step is to formally notify your landlord or property management company in writing about the issue, including photos. Request that they arrange for a professional mold inspection and subsequent remediation. Do not attempt cleanup yourself, as this could inadvertently make you liable. For an accurate assessment and to document the issue for your landlord, I strongly recommend a certified inspection.

Call 800-MOLDS or 800-66537 to have our team conduct a thorough assessment and provide a detailed report on the cause, which is crucial for determining liability.
