Is tenant or landlord responsible for black mold?« Back to Previous Page

We've lived in our Jumeirah apartment for two years and just noticed a large patch of black mold in the back of the bedroom closet. It's been really humid lately and I think it's been growing for a while behind our storage boxes. As a tenant, am I responsible for the cleaning and repairs, or is this something I need to report to the landlord to handle?

In the UAE, the responsibility for black mold remediation in a rental property like your Jumeirah apartment is typically defined by the cause of the problem, as outlined in Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai.

The landlord is responsible for the property's structural integrity and the maintenance of major building systems, including the central air conditioning. If the mold is a result of a structural defect, such as a leaking pipe within the walls, a faulty AC unit causing excessive condensation, or water seepage from the building envelope, the financial responsibility for professional remediation and repairs falls on the landlord. You must report this to them immediately to prevent further damage.

However, tenant responsibilities cover maintaining the property's cleanliness and ensuring adequate ventilation. The high humidity we experience, combined with year-round AC use, creates significant condensation. If the mold growth in your closet is determined to be due to tenant-induced factors—such as storing items tightly against walls, blocking airflow, failing to use the AC to control humidity, or not reporting a minor leak promptly—you could be held liable for the cleaning costs.

Given the extent you've described, a professional inspection is critical. DIY attempts often spread spores and fail to address the root moisture source. Our certified inspectors at Saniservice can conduct a thorough assessment to identify the exact cause and moisture source, providing a definitive report to determine liability. We then perform certified remediation using industrial-grade HEPA filtration and antimicrobial treatments to ensure the mold is safely and completely removed.
