Landlord or tenant responsible for AC leak and mold?« Back to Previous Page

The AC in my bedroom has been leaking a bit for a couple of months, and now I’m seeing black spots spreading on the wall behind the wardrobe. We’ve lived in this Jumeirah Village Triangle apartment for a year and my allergies have been terrible lately. Who is responsible for fixing this and testing if it's the dangerous kind of mold – me or my landlord?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for the maintenance of the main structural components of the property, including the central air conditioning system and the building envelope (walls, ceilings). An AC unit leaking for months, leading to moisture intrusion and subsequent mold growth on the wall, falls squarely under this category of structural maintenance.

The key factor is the source of the problem. Since the leak originates from the AC system—a fixture provided by the landlord—the responsibility to repair the leak and rectify the resulting damage, including the mold, is theirs. Your responsibility as a tenant is typically limited to reporting the issue in a timely manner, which you have done by noticing it over the past couple months. You are also responsible for maintaining cleanliness and not causing damage through negligence.

However, given that you are already experiencing severe allergic reactions, this is a serious indoor air quality issue that requires immediate professional attention. The black spots spreading behind the wardrobe are a significant biohazard and must be professionally tested to determine the species. Some molds, like Stachybotrys chartarum (black mold), produce mycotoxins that can cause severe health issues.

Do not attempt to clean this yourself, as disturbing it can aerosolize spores and exacerbate your allergies. You must formally notify your landlord in writing about the AC leak and mold growth, requesting immediate remediation. For a certified inspection and a detailed report that can be presented to your landlord, I strongly recommend contacting a professional service. They can identify the mold type, pinpoint the moisture source, and provide a scope of work for proper remediation.

Call 800-MOLDS or 800-66537 to schedule an inspection with a certified technician. They can provide the documentation you need to ensure your landlord addresses this health hazard correctly and promptly.
