Landlord or tenant responsible for bathroom mold?« Back to Previous Page

Our family bathroom in our Jumeirah apartment doesn’t have a window, and for the last couple of months, I’ve noticed black mold spots growing in the grout between the tiles and a constant damp smell. We try to ventilate it with the extractor fan, but the humidity just seems to get trapped. Since we're tenants, who is responsible for dealing with this – is it our job to clean it, or should our landlord handle the remediation?

In the UAE, the responsibility for mold remediation in a rental property is typically determined by the cause of the moisture. Under Dubai's rental laws (Law No. 26 of 2007), landlords are responsible for maintaining the structural integrity of the property. This includes addressing issues like faulty waterproofing, leaking pipes within the walls, or a defective building envelope that allows moisture ingress. If the mold is a result of such a structural or maintenance defect, the landlord is legally obligated to rectify it.

However, as a tenant, you are responsible for maintaining proper ventilation and hygiene. In a windowless bathroom common in Jumeirah apartments, this is a significant challenge. The extreme humidity and year-round AC use in Dubai create massive condensation issues. While the extractor fan is crucial, it may be undersized, clogged, or simply insufficient for the space. Daily practices like wiping down wet surfaces after showers, ensuring the fan runs for at least 30 minutes post-use, and using a dehumidifier are tenant responsibilities. Surface mold on grout from condensation is often considered a cleanliness issue.

Given your description of a "constant damp smell," this suggests a persistent humidity problem that likely exceeds a simple surface cleaning. We strongly recommend a professional inspection to identify the exact moisture source. Our certified inspectors use thermal imaging and moisture meters to differentiate between condensation and hidden leaks. This objective report is essential for determining liability between tenant and landlord.
