Who is responsible for black mold removal in a rental?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold I just found behind our wardrobe in the master bedroom. It's definitely been there a while, probably from the AC unit on the wall, but we only noticed it when we moved the furniture to rearrange. We're renting an apartment in Jumeirah Village Circle, so who is actually responsible for getting this professionally removed and paying for it, us or the landlord?

This is an excellent and very common question we get from tenants in Dubai, especially in high-humidity areas like JVC. From your description, this is a serious issue that requires immediate professional attention, not a DIY fix, especially with health symptoms present.

Under UAE law, specifically Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai (as amended), the responsibility for maintenance falls on the landlord. This includes structural issues and faults that affect the habitability of the property. A mold infestation caused by a leaking AC unit, a faulty seal, or water ingress from the building envelope is unequivocally a structural maintenance issue. The landlord is legally obligated to address the root cause and the resulting mold remediation.

Your first step is to formally notify your landlord or property management company in writing, with photos of the mold behind the wardrobe and the AC unit. They must arrange for a professional inspection to identify the moisture source. Simply cleaning the visible mold is insufficient; the underlying water issue must be fixed to prevent regrowth.

Given that your children are coughing, I strongly recommend you insist on a certified mold inspection and remediation company. improper removal can aerosolize spores and worsen the air quality. We need to conduct air quality testing, contain the area, remove contaminated materials safely, and use industrial-grade HEPA filtration to clean the air.

For immediate advice and to schedule a professional assessment, please call our team at 800-MOLDS (800-66537) or email hello@saniservice.com. We can provide a detailed report for your landlord outlining the cause and the necessary scope of work, which is often required to get them to act.
