Who is responsible for fixing a broken AC unit?« Back to Previous Page

The AC in our master bedroom has started making a weird rattling sound every time it kicks on, and it's been like this for about two weeks. The airflow also feels a lot weaker than the unit in the living room. We're in a two-year-old building in Jumeirah Village Circle and our maintenance contract with the landlord just expired last month. Who is responsible for getting this fixed and paying for it, me as the tenant or the building owner?

Based on the UAE Civil Code and standard tenancy contract procedures (EJARI), the responsibility for fixing a central AC unit lies with the property owner or landlord. The AC system is considered a fundamental part of the property's provided amenities, and its maintenance is typically the landlord's obligation unless otherwise explicitly stated in a very specific clause within your tenancy contract.

However, the recent expiration of the maintenance contract complicates matters. While the landlord is still financially responsible for the repair, they may not have an active service provider on call. You are obligated to inform them of the issue immediately in writing (email is best for documentation). The rattling sound you describe is a serious concern—it often indicates a failing compressor, loose components, or debris in the blower assembly, which can lead to a complete system failure if ignored. The reduced airflow could be a separate issue, like clogged ducts or a dirty filter, but the combination suggests a significant mechanical problem.

Given the technical nature of the fault and the potential for costly damage, we strongly recommend a professional inspection to diagnose the exact cause. Do not allow the landlord to send a general handyman; this requires a certified HVAC technician. We can provide a comprehensive assessment to determine the root cause and provide a formal report for your landlord.
