Who is responsible for fixing black mold in my apartment?« Back to Previous Page

We've lived in our Jumeirah apartment for two years and just noticed a bunch of black mold spots in the corner of our bedroom closet where the outside wall is. It’s been really humid lately and I think it might be a leak from the building's exterior. Who is responsible for getting this fixed and paying for it, me or my landlord?

Determining responsibility for black mold remediation in a Dubai apartment, such as your situation in Jumeirah, hinges on identifying the root cause, as outlined by UAE tenancy law. If the mold growth is a direct result of a structural defect or a leak from the building's exterior, as you suspect, the financial and repair responsibility falls squarely on the landlord. This is considered a maintenance issue pertaining to the property's structure, which the landlord is obligated to address under the rental contract and Dubai law.

However, if the cause is attributed to tenant behavior—such as inadequate ventilation, failure to use provided AC systems correctly leading to condensation, or internal moisture sources—the tenant may be held responsible for the resulting damage and cleanup.

Given the high humidity levels in Dubai and the propensity for condensation, especially on cooler external walls, a professional inspection is critical to establish causation definitively. Our process involves a thorough assessment, including moisture mapping and thermal imaging, to pinpoint the exact source of the moisture, whether it's an infiltrating leak or condensation. This technical report is vital evidence for determining liability.

For a conclusive diagnosis and a remediation plan that complies with Dubai Municipality standards, I strongly recommend a certified inspection.
