Who is responsible for mold in a Dubai rental?« Back to Previous Page

We've lived in our Jumeirah Village Triangle apartment for two years and just noticed a big patch of black mold in the corner of our master bedroom closet, the one on the outside wall. It seems to have gotten worse since the humidity really kicked in a couple of months ago. Our landlord is saying it's our fault for not ventilating properly, but we always run the AC.
Who is legally responsible for mold remediation in a rental here, the tenant or the landlord?

Based on UAE Civil Code and Dubai rental law, the responsibility for mold remediation typically falls on the landlord, as they are legally obligated to provide a habitable property free from structural defects. The key factor is determining the source of the moisture.
If the mold is due to a structural issue like a leaking pipe inside the wall, a faulty AC drainage line in the ducting, or water seepage from the building envelope (a very common issue in Jumeirah Village Triangle and similar communities), the landlord is 100% responsible for the repairs and the ensuing mold remediation. However, if the tenant's lifestyle is proven to be the direct and sole cause—for instance, consistently turning off the AC for long periods or generating excessive moisture without ventilation—the liability could shift. Simply running the AC is not always sufficient; ensuring it's set to a reasonable temperature (like 23-24°C) to properly manage humidity is crucial. Given your description of it being on an outside wall and worsening with seasonal humidity, this strongly suggests an infiltration or insulation issue, which is a structural problem. Your landlord's claim likely has little standing. We strongly recommend you get a professional inspection and detailed report. Our certified mold inspectors can identify the exact moisture source and provide a legally-defensible report to present to your landlord, outlining the required corrective actions. Don't attempt to remove it yourself, as improper handling can spread spores and exacerbate the problem.
