Who is responsible for mold in rental closet?« Back to Previous Page

Our master bedroom closet in our Marina apartment has been smelling really damp, and I just found a bunch of black fuzzy mold on the back wall and on some of our shoes. It's been getting worse since the humidity spiked a few weeks ago. We've been in this rental for about a year and always run the AC. Are we responsible for cleaning this and replacing our damaged stuff, or is this something the building management or landlord needs to fix?

Based on the conditions you've described in your Marina apartment, this is a classic case of mold proliferation driven by Dubai's high ambient humidity, exacerbated by potential micro-climates created within enclosed spaces like closets on exterior walls. The persistent damp smell and visible growth on both the wall and personal items indicate an ongoing moisture issue, likely condensation from the temperature differential between the air-conditioned room and the warmer wall surface, a common issue in our coastal climate.

Under UAE rental law, specifically Law No. (26) of 2007, the landlord is generally responsible for maintaining the property's structure and ensuring it is habitable. This includes addressing inherent defects that lead to moisture intrusion, such as faulty external waterproofing, leaking pipes within the walls, or insufficient insulation. As a tenant, you are responsible for maintaining cleanliness and reporting issues promptly. However, if the mold is a result of a structural flaw or a building-level issue with the HVAC system that prevents proper dehumidification, the liability falls on the property owner.

Given the extent of the growth, a professional inspection is critical. DIY cleaning is not advised for health reasons and because it often fails to address the root moisture source. Our certified inspectors use thermal imaging and moisture meters to pinpoint the exact cause—whether it's condensation, a hidden leak, or rising damp—and provide a legally defensible report for your landlord.

For immediate assistance and a comprehensive assessment, I strongly recommend you contact our team. We can determine the cause and provide the necessary documentation to clarify responsibility with your landlord.
