Who is responsible for mold inspection, tenant or landlord?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a patch of black mold spreading along the corner of our bedroom wall behind the wardrobe. I'm worried it's affecting our health, as my allergies have been awful lately. Our tenancy contract is a bit vague on this. Who is legally responsible for arranging and paying for a proper mold inspection here, the tenant or the landlord?

In Dubai, the responsibility for mold inspection is typically determined by the tenancy contract and the cause of the moisture. Under the Dubai Rental Law (Law No. 26 of 2007, amended by Law No. 33 of 2008), the landlord is legally obligated to maintain the property's structural integrity and ensure it is habitable. This includes addressing pre-existing dampness, faulty waterproofing, or inherent building defects that lead to mold growth, such as leaking pipes within the walls or a compromised building envelope.

However, the tenant is responsible for damage resulting from negligence or their own actions. In the UAE's humid climate, where condensation from year-round AC use is a major factor, tenant responsibilities include maintaining adequate ventilation, promptly reporting any leaks, and ensuring AC drain pans and drip lines are not clogged. If the mold is determined to be a result of placing furniture directly against an external wall (a common cold bridge for condensation) or failing to use the AC to control humidity, the tenant may be liable for the inspection and remediation costs.

Given the situation you described—a patch spreading behind a wardrobe on an external wall—this strongly points to condensation due to lack of air circulation, a very common issue in Jumeirah. However, a professional inspection is critical to definitively identify the moisture source. We strongly advise against DIY testing. A certified inspector will use tools like thermal imaging and moisture meters to diagnose the root cause and provide a legally defensible report.

For a comprehensive, Dubai-municipality-compliant inspection and a clear determination of liability, I recommend contacting our specialists at Saniservice. Call 800-MOLDS (800-66537) or email hello@saniservice.com to schedule an assessment. This will protect your health and provide the documentation needed to resolve the issue with your landlord.
