Who is responsible for mold removal, tenant or landlord?« Back to Previous Page

My kids have been coughing and I suspect it's the black mold I just found behind the wardrobe in our master bedroom. We've been in this Discovery Gardens apartment for a year, but I only spotted it today while rearranging furniture. The wall feels damp to the touch, and I'm worried it's been there a while. Who is responsible for handling and paying for the mold removal, me as the tenant or my landlord?

Based on the UAE Civil Code and common tenancy law practices in Dubai, the responsibility for mold removal is typically determined by the source of the moisture causing the infestation.

In your case, the damp wall behind the wardrobe is a critical indicator. If this dampness is a result of a structural issue, such as a leaking pipe within the wall, a faulty AC condensation drain line, or water ingress from the building envelope (a common issue in older buildings during rare heavy rains), then the repair and subsequent mold remediation are the legal responsibility of the landlord. The landlord is obligated to provide a habitable property and maintain the structural integrity of the building.

However, responsibility may fall to you, the tenant, if the mold growth is determined to be a direct result of tenant behavior. In Dubai's humid climate, this includes inadequate ventilation, failing to run the AC consistently to manage humidity levels, or activities that generate excess moisture without proper exhaust. Blocking walls with large furniture like wardrobes can create cold spots where condensation forms, especially when the AC is blowing directly on it, providing the perfect environment for mold.

Given that you have health concerns (children coughing) and visible black mold, a professional inspection is absolutely essential. We strongly recommend you contact your landlord immediately to report the issue and request a professional assessment. Do not attempt to remove significant mold growth yourself, as improper remediation can aerosolize spores and worsen the indoor air quality.
