Who is responsible for black mold in my rental apartment?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a patch of black, fuzzy mold spreading from the corner of our bedroom ceiling. It’s gotten much worse since the humidity spiked last month. Who is responsible for dealing with this and the potential damage – us as tenants or the landlord?

In the UAE, the responsibility for black mold remediation in a rental property is primarily determined by the cause, as outlined in Law No. (26) of 2007, known as the Dubai Rental Law.
If the mold growth is a direct result of a structural defect, such as a leaking pipe within the walls, a faulty air conditioning condensation drain line, or water ingress from a poorly sealed window or external wall, the financial and repair responsibility falls to the landlord. The landlord is obligated to maintain the property's structural integrity and ensure it is habitable. However, tenant liability comes into play if the mold proliferation is due to occupant behavior. In Dubai's extreme climate, this most commonly involves inadequate ventilation leading to condensation. If a tenant consistently runs the AC at a very high temperature with closed curtains, blocks AC vents, or fails to use exhaust fans in bathrooms and kitchens, the resulting humidity and condensation create the perfect environment for Stachybotrys chartarum (black mold) to thrive. In such cases, the tenant may be held responsible for the cost of remediation and any associated damages. Given the potential health risks and structural damage, a professional inspection is critical to determine the exact cause. Our certified inspectors at Saniservice use tools like thermal imaging cameras and moisture meters to identify the source of moisture conclusively. This evidence-based report is essential for delineating responsibility between tenant and landlord.
