The AC in my apartment in JLT has been leaking a bit, and now I’ve found black mold spreading on the wall behind my bedroom wardrobe. My two-year-old has had a runny nose and a cough for over a week now that won’t go away. I’ve reported the leak to the landlord, but they’re taking their time. Am I legally allowed to get a professional mold inspection done myself and deduct the cost from the rent, or is that the landlord's full responsibility to handle?

In Dubai, you cannot unilaterally deduct the cost of a mold inspection from your rent. The responsibility for maintaining the property's structure, including fixing leaks that lead to mold, falls on the landlord. Your first step is to formally report the issue in writing to the landlord or building management, which you've done, and keep a record of all communication.

For urgent health and safety issues, Dubai's rental law (Law No. 26 of 2007) allows you to apply to the Rental Dispute Centre (RDC) for a swift resolution. Given the visible black mold and your child's persistent respiratory symptoms, this qualifies as a serious habitability concern. The RDC can issue an order for the landlord to rectify the problem immediately. It is far more effective to have the RDC compel the landlord to pay for both the leak repair and a proper remediation, including professional inspection and testing, than to pay for it yourself and seek reimbursement later, which is a more difficult legal path.

A professional inspection is critical here. The constant humidity and year-round AC use in JLT create a perfect environment for mold, especially from an unresolved leak. A proper inspection will identify the mold species and the full extent of the contamination, which is often hidden inside walls or AC units, and provide a scientific report. This documented evidence is what you would need to present to the RDC to substantiate your case and ensure the remediation is done correctly, not just cosmetically.
