Is my landlord responsible for fixing mold causing sickness?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold I just found growing along the bottom of our bedroom wall in Silicon Oasis. It's been getting worse ever since the heavy dew season started last month, and the wall almost feels damp to the touch. Our landlord says regular AC maintenance is our responsibility. Are they actually liable for fixing the cause of this, or do I have to handle the repair myself?

Under Dubai rental law (Law No. 26 of 2007), a landlord is responsible for maintaining the structural integrity of the property. This includes addressing the root cause of moisture intrusion, such as a leaking pipe, faulty external waterproofing, or a structural defect that allows condensation or water seepage. The persistent dampness you describe, especially during the high humidity and heavy dew season, points to a potential structural issue that likely falls under their obligation.

Your responsibility typically covers routine maintenance like changing AC filters to prevent internal unit mold. However, the mold growth on the wall itself, particularly if it is causing health symptoms, is a strong indicator of a moisture problem originating from the building's structure. Document everything: take clear photos of the mold and the damp wall, note the dates you first noticed it, and keep a record of your children's symptoms and any communication with the landlord.

Formally notify your landlord in writing about the issue, stating it is affecting your family's health and request they investigate and rectify the source of the moisture. If they are unresponsive, you can file a complaint with the Rental Disputes Center (RDC) in Dubai. For immediate health concerns and to properly identify the mold type, a professional indoor environmental assessment with lab analysis is advised to confirm the extent of the issue and its cause.
