Is landlord responsible for mold from building issues?« Back to Previous Page

The wall behind our sofa in the living room has started showing these dark, fuzzy patches, and it’s definitely getting worse. We’ve been in this Discovery Gardens apartment for over a year and I think the issue started after that big sandstorm and rain we had a couple of months back. The landlord is saying it's our fault for not ventilating properly, but we run the AC constantly. Who is legally responsible for the mold remediation costs in a rental, the tenant or the landlord, especially when it might be due to a building envelope issue?

In Dubai rentals, the landlord is generally responsible for structural repairs, including mold caused by building envelope issues like water intrusion from a sandstorm or a leaking pipe within the walls. Tenant responsibility typically covers damage from their own negligence, such as failing to report a leak or extreme lack of ventilation.

Your situation points to a potential building defect. The timing after a major weather event suggests water may have been driven through the building's exterior. Constant AC use, while creating a temperature differential that can lead to condensation, is a standard practice in Dubai and not typically considered negligence. The landlord's claim that you are at fault for "not ventilating properly" is weak, as most Dubai apartments rely on mechanical ventilation (AC) year-round, not open windows, due to the heat and humidity.

Your first step is to formally notify the landlord in writing (email is best) with clear photos and a request for a professional inspection to determine the moisture source. Do not attempt to clean it yourself, as this can disturb toxic spores and remove evidence. For disputes, you can file a case with the Rental Dispute Center (RDC) in Dubai. They will often require an expert technical report to ascertain the cause. A certified mold inspector can provide a decisive report identifying the moisture source—whether it's an internal leak, condensation, or external water ingress—which is crucial evidence for the RDC.
