Is landlord responsible for mold remediation in Dubai rental?« Back to Previous Page

The wall behind our sofa in the living room has a growing black patch, and we’ve noticed it’s gotten bigger since the heavy humidity a few weeks ago. Our two-year-old has had a persistent cough that our doctor said could be from mold. We’re renting in Jumeirah Village Circle, and I’m worried about our health and the wall. Is the landlord legally required to handle and pay for the black mold remediation, or is this on us as tenants?

Based on the Dubai Rental Law (Law No. 26 of 2007), the responsibility for mold remediation is determined by the source of the moisture. The landlord is legally obligated to maintain the property's structural integrity. Therefore, if the black mold is a result of a structural issue, such as a leaking pipe within the walls, a roof leak, or faulty external waterproofing that allows moisture ingress, the remediation cost falls squarely on the landlord.
However, as a tenant, you are responsible for maintaining the property in a clean and habitable condition. If the moisture source is determined to be from tenant-related activities—such as inadequate ventilation leading to condensation, failure to use exhaust fans, or not running the AC sufficiently to manage the high humidity levels endemic to Dubai—the financial responsibility for cleanup could be yours. The persistent humidity we've experienced exacerbates these conditions, especially if the AC is not set to a consistently low humidity level. Given that you have a health concern with a young child, a professional inspection is critical. We must identify the exact species of mold (e.g., Stachybotrys chartarum, or "black mold," is particularly concerning) and the precise moisture source to assign liability correctly. Our certified inspectors at Saniservice use thermal imaging and moisture meters to conduct a non-invasive investigation and provide a definitive report that can be used to discuss responsibilities with your landlord.
