Is landlord responsible for mold remediation in JVC apartment?« Back to Previous Page

My kids have been coughing for a couple of weeks and I suspect it's from the black mold I just found spreading along the base of the wall behind our bedroom wardrobe. We’ve lived in this Jumeirah Village Circle apartment for a year, and the wall feels damp to the touch. Is the landlord responsible for the mold remediation and the repainting, or is this on me to fix?

Under Dubai rental law, the landlord is generally responsible for structural repairs and issues arising from inherent building defects, which often includes mold remediation. Since the mold is behind a wardrobe on a damp wall, this strongly suggests a leak or condensation issue within the wall itself—a structural problem. Your first step is to formally notify the landlord or property management company in writing, detailing the issue and including photos of the mold and dampness.

JVC apartments, like many in Dubai, are highly susceptible to mold due to the high humidity and constant AC use, which can create condensation if units are not properly maintained or if insulation is faulty. This is typically considered a maintenance issue for the property owner to address. They are obligated to investigate and fix the source of the moisture, perform the necessary mold remediation, and restore the wall. Repainting would logically be part of that restoration process after the underlying dampness is resolved and the mold is professionally removed.

For a case this advanced, with visible growth and health symptoms, a professional inspection is crucial to identify the exact moisture source and extent of contamination. This provides documented evidence for your landlord. While you wait for a response, move the wardrobe away from the wall to improve air circulation and consider using a dehumidifier in the room. Keep records of all communication. If the landlord is unresponsive, you can escalate the matter to the Rental Dispute Center (RDC) in Dubai.
