Is AC leak causing mold a tenant's repair responsibility?« Back to Previous Page

Our master bedroom AC unit has been leaking a bit for a couple of months, and now we’re finding small black, speckled patches on the wall behind the curtain and the ceiling corner. My husband’s allergies have been terrible lately, and I’m worried it’s the mold. As a tenant in Jumeirah Village Circle, am I responsible for paying to fix this and clean it, or is this something the landlord or building management has to handle?

The AC leak is almost certainly the source of the mold. In Dubai's high humidity, any persistent moisture from a condensate drain leak creates the perfect environment for mold growth, often within 24-48 hours. The black speckled pattern is a common visual indicator, and the timing of your husband's worsened allergies strongly suggests a connection.
Regarding responsibility, the repair of the AC unit itself typically falls to the landlord or building management, as it is a fixed installation. This is a standard expectation in tenancy contracts for Dubai. The mold remediation, however, can become a grey area. You are responsible for reporting maintenance issues in a timely manner. Since the leak has been ongoing for months, the landlord could argue that the resulting mold damage is due to a failure to report, potentially making you liable for the cleanup costs. Your immediate step is to formally notify your landlord or property management company in writing (email is best), detailing the AC leak and the visible mold growth. Include clear photographs. Request that they arrange for an AC technician to repair the leak and for a professional mold inspection. A proper inspection involves more than a visual check; it should include moisture mapping and, if necessary, air or surface sampling to identify the species and concentration, which dictates the remediation protocol. Until it is resolved, keep the area ventilated and avoid disturbing the mold, as this can release spores. Simply wiping it is insufficient and can spread it; the underlying moisture problem must be fixed first. For health concerns, an air purifier with a HEPA filter in the bedroom can help reduce airborne spore levels. |
