Who pays for mold removal in Dubai Silicon Oasis rental?« Back to Previous Page

My kids have been coughing and I suspect it's because of the black mold that's been spreading along the bedroom wall near the AC unit. We've lived here for 2 years and just noticed it, but it's gotten much worse since the humidity started last month. I’m not sure if this is something I should fix myself or if my landlord in Dubai Silicon Oasis is responsible for handling it. Who is legally responsible for the cost of mold remediation in a rental here?

Under Dubai rental law (Law No. 26 of 2007), the responsibility for mold remediation hinges on the cause of the moisture. The landlord is legally obligated to maintain the property's structure, including fixing leaks from plumbing, roofing, or faulty window seals that lead to mold. However, if the mold is a result of tenant behavior—such as inadequate ventilation, failing to use AC to control humidity, or blocking wall vents—the tenant may be responsible for the cost of cleanup.

Given Dubai's high humidity, especially during the summer months, condensation around AC units is a common catalyst for mold growth on walls. The black substance near your AC is likely Stachybotrys or Aspergillus, which are frequently identified in such damp conditions and are known to cause respiratory irritation and persistent coughing, particularly in children.

For a case involving visible spread and health symptoms, a professional inspection is strongly advised to identify the exact moisture source. This documented assessment is crucial for determining liability with your landlord. You should formally notify your landlord or property manager in writing about the issue, citing your concerns about your children's health. If the mold is a result of a structural or maintenance issue, they are required to address it. If they refuse, you can file a case with the Rental Dispute Center in Dubai (RDC). For immediate health safety, avoid disturbing the mold yourself, as this can release more spores; focus on improving ventilation and maintaining a consistent AC temperature to reduce humidity until it is professionally assessed and remediated.
