Is landlord responsible for AC leak and mold?« Back to Previous Page

The AC in our Deira apartment has been leaking a bit, and now I've found a patch of black mold on the wall behind the bedroom curtain. We’ve been here for almost a year and this just started after the last maintenance check. Who is responsible for dealing with this and the repair – me as the tenant or my landlord?

In the UAE, the responsibility for repairs such as an AC leak and resulting mold growth is typically defined by the tenancy contract and governed by Law No. (26) of 2007, known as the Dubai Rental Law. Generally, the landlord is responsible for the maintenance of the property's main structure and central systems, including the air conditioning system, provided the damage is not due to tenant misuse or negligence.
The scenario you describe—an AC leak occurring after a maintenance check—strongly suggests a fault with the AC unit itself, which is a fixture and a central part of the property. The subsequent black mold growth is a direct result of that moisture intrusion. Given Dubai's high humidity levels and the constant reliance on AC, condensation and leaks must be addressed immediately to prevent microbial amplification. Black mold, particularly of the Stachybotrys variety, is a serious health and structural concern. Your first action should be to formally notify your landlord or property management company in writing, detailing the issue and including photographs. They are generally obligated to arrange for the repair of the AC unit. For the mold remediation, however, this requires specialized intervention. Standard cleaning is insufficient and can exacerbate spore dispersal. I strongly recommend a professional inspection and remediation process. Our team at Saniservice can conduct a comprehensive assessment to determine the extent of the mold contamination, identify the moisture source definitively, and provide a certified hygienization protocol to ensure the mold is removed safely and effectively, restoring your indoor air quality.
